At DataPath:

We
collect only customer information that is needed, and we tell customers how we
use it. We limit
the collection of information about our customers to what we need to know to
administer their accounts, to provide customer services, to offer new products
and services, and to fulfill any legal and regulatory requirements. We tell our
customers about the general uses of information we collect about them, and we
will provide additional explanation if customers request it.

We
give customers choices about how their data will be used. On a regular basis, we give our
customers the option to decide whether or not they wish to have their names
removed from lists used for mail, telephone and online marketing. These opt-out choices include product and service offers from
DataPath. This policy extends to our business partners, which restricts direct
contact with our customers, unless you instruct us to.

We
ensure information quality. We use advanced technology and well-defined employee
practices to help ensure that customer data is processed promptly, accurately
and completely. We also strive to
render support services that are accurate and timely, according to the
pre-defined practices and Federal rules and regulations governing benefit
administration services.

We
use information security safeguards. Access to customer data is limited to those who specifically
need it to conduct their business responsibilities. We use security techniques
designed to protect our customer data -- especially when certain data is used
by employees and business partners to fulfill customer services.

We
limit the release of customer information. In addition to providing customers with the
opportunity to opt out of marketing offers, we release information only with
the customers' consent or request, or when required to do so by law or other
regulatory authority. When a court order or subpoena requires us to release
information, we will notify the customer promptly to give the customer an
opportunity to exercise his or her legal rights. The only exceptions to this
policy are when we are prohibited by court order or law from notifying the
customer, or cases in which fraud and/or criminal activity is suspected.

are responsive to customers' requests for explanations. If we deny an application for our
services or end a customer's relationship with us, to the extent permitted by
applicable laws, we provide an explanation, if requested. We state the reasons
for the action taken and the information upon which the decision was based,
unless the issue involves potential criminal activity.

We
extend these privacy principles to our business relationships. We expect the companies we select as
our business partners to honor our privacy principles in the handling of
customer information. These include companies that (a) assist us in providing
services to our customers; (b) supply us with information for identifying or
evaluating prospective customers; or (c) are supplied with your information for
the purpose of providing products and services to our Customers. In selecting
business partners, DataPath considers the accuracy and quality of the data they
provide, how they respond to consumer complaints and whether or not they
provide opt-out choices for those whose information they process.

We
hold employees responsible for our privacy policy. Each DataPath employee is personally
responsible for maintaining consumer confidence in the company. We provide
training and communications programs designed to educate employees about the
meaning and requirements of these Customer Privacy Principles. Employees who violate these principles or
other company policies and practices are subject to disciplinary action, up to
and including dismissal. Employees are expected to report violations -- and may
do so confidentially -- to their managers, to the business Owners.
DataPath is a Benefits
Software Solutions Provider that uses technology to offer services and products
to the Benefit Administration Market place.
DataPath was founded in 1984 for the purpose of developing software
solutions. The company is a leader in
Cafeteria Plan Software and Services, including supplemental Web and Internet
services. DataPath, also offers other
products and services, including, COBRA, Health Reimbursement and Tax-Free
Transportation Systems. In each of
these Lines of Service, we have relationships with customers -- individuals and
businesses who are potential or existing customers and clients. We collect
information necessary to enroll them as customers, to provide the services they
have selected, to support products that have purchased and to offer them
additional or related DataPath products and services.
We also obtain information
about customers from other companies and public sources to identify those who
we think will be interested in specific DataPath products and services, and we
use this information to offer these products and services to them.
Because we strongly
advocate the protection of customer information, we believe that the adoption
and implementation of the DataPath Customer Privacy Principles, above, are good
business practices, and will serve the interests of our customers in effective privacy
protection. These Principles will be
updated from time to time in order to reflect changes in Law, the Market and
Administration practices.
These Customer Privacy
Principles guide our conduct in the collection, use, release and security of
customer information, as well as the responsibilities we assume as employees,
including our dealings with our business partners.
These principles define our
commitment to protect the privacy of our various customers. Each DataPath Line
of Service may maintain its own additional rules and practices, which are fully
consistent with these principles, and which they may modify as needed for
particular products and services, or to conform to local laws and/or Federal
laws.

DataPath collects, uses and safeguards the personal information you provide to

DataPath realizes how
important security is to you, so we’ve taken a number of steps to enhance the
safety and confidentiality of personal information sent to or from DataPath,
whether over the Internet, by email, by web-access, by fax or by direct-mail.
In particular, we require that a “secure session” first be established, using
Secure Socket Layer (SSL) technology. This is done anytime you supply or access
Card account information in one of our secure online areas, such as myRSC.com
or dpath.com sites.
Simply put, SSL technology creates a private conversation that only your
computer and DataPath systems can understand. The SSL technology secretly
encodes information as it is being sent over the Internet between your computer
and DataPath systems, helping to ensure that the information remains
confidential. The use of SSL requires two components: an SSL-compatible browser
and a Web server to perform the “key-exchange” that establishes an SSL
connection to DataPath Web server systems.
To benefit from SSL technology, you will need a browser with SSL capabilities.
Examples of SSL browsers include Netscape 2.0, Microsoft’s Internet Explorer
2.0, and the Web browser for America Online version 3.0 for Windows. (Note that
some older versions of browsers will not support SSL sessions). If you don’t
already have a browser with SSL capabilities, you can download an SSL browser
from any of the links below.
DataPath believes strongly
that we have a responsibility to protect your confidential information to the
best of our abilities. In the case of the Internet, securing access to you,
your clients and their employees benefit account information. Or in the case of offline information
providing firewall and a systems network designed to prevent unauthorized
access, either externally by hackers or internally by unauthorized
personnel. We recommend you use the
latest browser versions available. Access with Netscape versions before 1.12
(Mac or Unix) or 1.22 (Windows) is prohibited due to security concerns.
Nearly all Internet Service
Providers (ISPs) automatically enable the SSL session described above, as do
most online services such as America Online, CompuServe, and Prodigy. If you
use your company’s internal connection to access the Internet and you find you
cannot access DataPath’s secure pages with an SSL browser described above, your
company may be blocking access via a “firewall.” Please speak to your firm’s
Internet access systems administrator for further details on your network’s
Internet access.
In addition, if trying
access private information online, certain areas require the use of an ID and
password as an additional security measure that helps protect your confidential
information. This lets DataPath verify exactly who are logging onto the
DataPath site, thereby allowing access to account information, and helping
prevent unauthorized access
When you have finished
using a secure area of DataPath Web Services (e.g., EFT Processing),
make sure you always click on the “Log Off” link, which appears on the
upper right hand side of every secure page. When you click on it, you will be
taken to the Login Page, which effectively ends your secure session. No further
secure transactions can be conducted without re-entering your User ID and
password.
You should be aware that
browser software often “caches” pages as you look at them, meaning that some
pages are saved in your computer’s temporary memory. Therefore, you may find
that clicking on your “Back” button shows you a saved version of a previously
viewed page. Please keep in mind that caching in no way affects the security of
your confidential User ID or password. If you use a computer in a public place
to access your account information, please quit/exit the browser software
before leaving. This will decrease the possibility of anyone else viewing your
confidential information. No other users will be able to access your companies
account information or in the case of employees their benefit account information,
online without your User ID and password.
Please note: If you have chosen to disable
cookies on your browser, you will not be able to access confidential
information. This is because we use cookies to securely store your User ID and
password in order to recognize you when you return to the site. Please read About Cookies to learn more.
Other Companies
In order to bring you the many products and services offered by DataPath, we
work with carefully selected business partners and vendors. If we have to share
any information with these companies in order to provide the product or
service, we first conduct a careful evaluation of their information and
security systems and practices, and require administrative, technical and
physical safeguards to ensure the security and confidentiality of DataPath
customer information. At any time, we may audit our partners and vendors to
verify the continued security of their systems and practices.
Third-Party
Advertisement Servers
We hire other companies to place our banner ads on other Web sites and to
perform the tracking and reporting activities described above
("third-party advertisement servers"). They do not collect personally
identifiable information in doing this work for us, and we do not give any
personally identifiable information to them. Use of third-party advertisement
servers' tracking technologies is subject to their own privacy policies. If you

When you browse dpath.com
or myRSC.com and have not registered for any online service from DataPath, you
browse anonymously. Personal information -- such as your name, address, phone
number or E-mail address -- is not collected as you browse. DataPath does,
however, use "cookies" to collect information about how our site is
used. Information, such as the server your computer is logged onto, your
browser type (for example, Netscape or Internet Explorer), and whether you
responded to a DataPath banner ad or E-mail is collected and tracked in
aggregate. This information is used for the purpose of measuring response rates
to banner ads and e-mail offers.
Registration for Online
Products and Services. In order to provide you with a particular product or service online, we
may request that you voluntarily supply us with personal information, including
your E-mail address and customer account number for purposes such as
correspondence, site registration, checking your bill or benefits online,
performing a line of service, or participating in online surveys and enabling
us to provide an online product or service to you in an efficient manner.
If you are known to us as a
registered user of an DataPath online services, we may combine information
about your use of dpath.com or myRSC.com and the online product or service you
utilize with certain other online and offline information we have about you as
a DataPath customer and information you have provided to us in order to customize
your online experience, to enhance our Administration software products and to
provide online and offline updates to our services and products. We also use a
"cookie" to enable our server to recognize you as a registered
DataPath online service user when you re-enter our site. (If you would like to

You should be aware that
other Internet sites to which you link from dpath.com or myRSC.com may contain
privacy provisions that differ from the provisions of our Privacy Statement.
We may use information you
have given us to, for example, provide a service, ensure proper billing,
measure consumer interest in our various services and inform you about products
and services. If you have provided your E-mail address to us or to a company
we’ve partnered with to make their products and services available to you, we
may send you E-mail offers. We may also send you E-mail offers if you have
provided your E-mail address to a third party and have actively chosen or
requested, on an opt-in basis, to receive E-mail offers from other parties.
These offers may be based on information you provided in your initial
transaction with us, in surveys, or from information that may indicate how
services and products are used. These E-mail, Direct mail, Fax and Telephone
offers come directly from DataPath. You can opt out from receiving these or any
offers from DataPath as described below in the section, "Declining

When we send E-mails to
you, we may be able to identify information about your e-mail address, such as
whether you can read graphic-rich html e-mails. If your e-mail address is
html-enabled, we may choose to send you graphic-rich html e-mails.
Please note that we do not
provide your E-mail address to our business partners. However, we may send you
offers on behalf of our business partners. Keep in mind that if you take
advantage of an offer from a DataPath business partner and become their
customer, they may independently wish to send offers to you. In this case, you
will need to inform them separately if you wish to decline receiving future
offers from them.
Our goal is to deliver
offers to people who we believe will find them of value. Offers are developed
and managed under strict conditions designed to safeguard the security and
privacy of customer personal information.
Declining E-mail,
Direct-Mail, Fax and Telephone Offers
DataPath provides customers
with an easy means to decline receiving offers. Although some customers tell us
they appreciate receiving notice of these carefully designed opportunities, we
recognize the importance of providing you with choices. At any time, you may
request to discontinue receiving these offers from us by simply replying to the
E-mail and informing us of your preferences or by contacting our Customer
Support Department. All E-mail offers that you receive from DataPath will
inform you of how to decline receiving further E-mail offers. Additionally, you
may set
or change your E-mail preferences online at any time.
In keeping with our
commitment to your privacy and the protection of confidential information,
DataPath is proactive when designing services and products that will store
personal information. It is our goal to
identify security issues and build systems/services that preclude unauthorized
access. Although, DataPath cannot be
held liable for personal and confidential information located on our customers
network systems, we do promise to strive for a standard of best practices when

Cookies were originally
