START PLANNING TODAY TO ATTEND DATAPATH'S 2005 ANNUAL CONFERENCE

IRS Eases the "Use it or Lose It" Rule

On May 18, 2005, the IRS issued Notice 2005-42 which allows the deadline for incurring FSA and DCAP expenses to be extended for up to 2 ½ months after the end of the plan year. Medical expenses incurred during this period can be reimbursed from funds remaining in the accounts at the end of the Plan Year.

This ruling poses many unanswered questions. (Click here to read an analysis of this ruling by John Hickman and Ashley Gillihan of Alston & Bird.) DataPath is studying these questions before deciding on what actions it should take in response to this ruling.

We need your input! We also need your input on the effect of this ruling before we make our decisions. You can participate in a DataPath survey by clicking here or visiting www.dpath.com. Please submit your responses as soon as possible.

DataPath Announces Plan for 2005 Annual Conference

The DataPath Annual Conference this year will be held September 21-23 at the Grand Casino and Resort in Tunica, Mississippi, just 20 miles south of Memphis. (Click here to see a map.)

We are planning another great conference filled with news and information on the role of the Plan Service Provider (PSP) and the Third Party Administrator (TPA) in today's marketplace.

If you are wondering about Grand Casino - Tunica, it is located in Tunica County, MS, and is the third largest gaming market in the nation with nine world-class casinos featuring 24-hour gaming plus all the amenities of modern full-service vacation resorts. And since casino gaming was only legalized in Mississippi in 1990, all of the facilities are quite new, luxurious, and beautifully well-kept.

Health Care Costs:
Growth Rate is Slowing!

BusinessWeek online reports good news—the growth rate of medical costs is slowing! For the 12 months ending March 2005, the growth rate was down to 7.5% for private employers, according to the Bureau of Labor Statistics.

The Bureau gives some of the primary reasons for the slowing of the growth rate as lower price increases and the shifting of a larger share of health costs to employees . However, the big players (such as GE and Ford Motor) are looking to a common underlying factor as the reason—the introduction of "consumerism" into the healthcare market. These employers and others are offering new programs with one overriding goal—to make employees more discriminating consumers of healthcare services. You know the name of this type of programs—consumer-driven healthcare plans (CDHPs).

Watch for an article next month on how DataPath is responding to today's demand for CDHPs!

HR 1872: Health Coverage for the Uninsured

HR 1872 has been introduced by Representatives Sam Johnson (TX), Eric Cantor (VA), Paul Ryan (WI), and J.D. Hayworth (AZ). The purpose of this bill, as stated in their announcement, is as follows:

  1. To encourage individuals to buy affordable health insurance by giving an above-the-line deduction for the cost of health care premiums,
  2. To encourage small business to offer HDHPs by giving a tax credit to employers who make contributions to their employees' HSAs, and
  3. To make health care insurance more affordable for low-income people by giving them a tax credit for purchasing health insurance.

To read this Bill, go to http://thomas.loc.gov/, type in "HR 1872" and click on "Search".

If you want to write your Representative and give your opinion, you can click here to identify your Representative and find out how to contact him.
