IRS Releases New HSA Guidance on
Coordination of HSAs, HRAs, and FSAs

On May 11, 2004, IRS issued a press release announcing the issuance of Rev. Rul. 2004-45, clarifying how Flexible Spending Arrangements (FSAs) and Health Reimbursement Arrangements (HRAs) can interact with Health Savings Accounts (HSAs).

Possibly the most welcome item in Rev. Rul. 2004-45 permits employers to allow their employees to temporarily suspend HRA benefits for the coverage period. This suspension allows the employee to contribute to an HSA without forfeiting any accumulated HRA benefits, and gives the employer transitional relief when adopting high deductible health plans (HDHPs) with HSAs.

One Step Closer
to $500 FSA Rollover 

On May 13, 2004, the House of Representatives approved HR 4279 by a vote of 273-152. The bill, which would allow FSA rollovers of up to $500, passed on a bipartisan vote with 50 Democrats supporting the measure.

“We are moving closer and closer to changing the ill-considered use-it-or-lose-it rule and encouraging employees to save their health dollars,” commented ECFC Executive Director Bonnie H. Whyte.

Global Claims Processing

DataPath’s new add-on system, Global Claims Processing (GCP), is now available for those administrators with employers offering two or more of the following Plans: § 125 Cafeteria Plans, § 105 Health Reimbursement Plans, and § 132 Tax-Free Transportation Plans.

The claim entry screen in GCP permits claim entry for reimbursements under § 125, § 105, and § 132 Plans. Even if the claim is to be paid from more than one Plan, the claim needs to be entered only once. The system looks at the parameters for each employer’s plans (entered from other GCP screens) and seamlessly directs the claim to be paid from the appropriate Plan.

Finally: Justice Department
Sues “Double Dippers” 

For the last few years, we have heard that the “double-dip” schemes were fraudulent, but nothing was done to stop them. You’ve had a hard-time explaining to employers why you could not provide a similar program when the "double-dip" marketers were continuing business. Times will change now.

The Justice Department has filed a civil injunction complaint alleging that 200 employers have illegally disguised wages as healthcare benefits in order to report lower federal employment taxes. The complaint estimated the tax loss to the U.S. Treasury resulting from these employers’ actions may be as high as $63 million.

New Document Set for
myResourceCard® 

The document set for myResourceCard® has been updated, and will be released shortly.. The document set consists of (1) the Card Account Agreement between the Bank and the Employer, (2) the Card Holder Agreement between the Bank and the Employee, and (3) the Program Agreement between the Employer and the Employee.

The document set is substantially the same, but has been simplified and shortened. For instance, the Card Activation Agreement has been condensed from ten pages to only three pages, and the format for the Card Holder Agreement has been changed from individual sheets to a multi-fold single-piece document.
