As always this time of the year, the IRS has been extremely busy releasing new items. Some of these are as follows. "Qualifying Child" Fact Sheet. IRS
has posted a fact sheet explaining the recent change to the "qualifying
child" definition. IRS Information Letter on Double-Dipping Transportation Plans.
IRS has released an Information Letter which shows their disapproval
of double-dipping § 132 Transportation Plans. Final Version of Form 8889 and Instructions. IRS has
released the final version (replacing draft version released in 2004)
of Form
8889 for Health Savings Accounts (HSAs). Account holders are required
to attach this form to their Form 1040s to report HSA information.
No substantive changes were made. Tax Treatment of HSA Contributions by Partnerships and S Corporations. IRS
Notice 2005-8 (Jan. 12, 2005) addresses the tax treatment of HSA contributions
made by (1) partnerships on behalf of partners and (2) S Corporations on behalf
of two percent shareholder/employees. Final 401(k) and 401(m) Regulations. On December 29,
2004, IRS released finalized 401(k) and 401 (m) regulations that
were issued in proposed form on July 17, 2003. In addition to
clarifying and modifying existing guidance, these regulations
add new anti-abuse and hardship provisions.
