DataPath Plan Documents to Remain Unchanged For 2008 Plan YearWhile DataPath is not updating Cafeteria Plan documents for plan years beginning in 2007 or 2008, there have been some regulation changes, that if the employer elects to allow, will require amendments to plan documents and SPDs, such as the end of year FSA rollover to an HSA. DataPath does not create amendments as they are usually client specific. DataPath's attorneys are working on new plan documents for plan years beginning in 2009, as there are some changes that must be made due to the new proposed cafeteria plan regulations which are effective 1/1/09. Please remember that DataPath provides Plan Documents and SPDs as templates only, and we provide them in a Word format so that the TPA has the flexibility to amend them as they feel is necessary. The TPA should always edit the documents to suit the employers' cafeteria plan specifications. The TPA should also advise their clients to have the documents reviewed by their attorney prior to adopting them (signing them), as they are the legal plan administrator and responsible for the plan.
